Acceptance of Terms
By booking a service with Rogue Marine Adventures (“Company”), you (“Customer”) agree to comply with and be bound by these Terms and Conditions. Please read them carefully before making a booking.
Booking and Payment
Reservation: All bookings must be made in advance and are subject to availability. A deposit may be required at the time of booking.
Payment Methods: We accept payments via credit card, debit card, and other online payment methods as specified during the booking process.
Payment Terms: Full payment must be made before the service commences. Failure to make timely payments may result in cancellation of your booking.
Cancellation and Refund Policy
Customer Cancellation: Cancellations made more than 36 hours before the scheduled service will receive a full refund. Cancellations made within 24 hours of the scheduled service will be charged 50% of the booking fee. No-shows will be charged the full booking fee.
Company Cancellation: The Company reserves the right to cancel or reschedule services due to weather conditions, safety concerns, or other unforeseen circumstances. In such cases, Customers will be offered a full refund or an option to reschedule.
Safety and Conduct
Safety Requirements: Customers must adhere to all safety instructions and guidelines provided by the Company’s staff. Failure to comply may result in termination of the service without a refund.
Prohibited Conduct: The Company reserves the right to refuse service to any Customer displaying inappropriate or unsafe behavior, including but not limited to intoxication, aggression, or disregard for safety protocols.
Liability and Indemnity
Assumption of Risk: Customers acknowledge that participation in marine and water activities involves inherent risks. By booking a service, Customers assume all risks associated with such activities.
Limitation of Liability: The Company shall not be liable for any direct, indirect, incidental, or consequential damages arising out of or in connection with the use of its services. This includes, but is not limited to, personal injury, property damage, or loss of life.
Indemnification: Customers agree to indemnify and hold harmless the Company, its officers, employees, and agents from any claims, damages, losses, or expenses arising out of or related to their participation in the Company’s services.
Use of Equipment
Responsibility: Customers are responsible for any damage to or loss of the Company’s equipment during the rental period. Charges for repair or replacement may apply.
Inspection: Equipment must be inspected by the Customer before use. Any pre-existing damage should be reported to the Company’s staff immediately.
Privacy and Data Protection
Personal Information: The Company collects personal information necessary for the provision of services. This information is handled in accordance with local State and Federal policies.
Consent: By providing personal information, Customers consent to its use in accordance with the Company’s Privacy Policy. No information is shared with third party retailers, marketers, or advertisers.
Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the State of South Carolina. Any disputes arising under or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of Beaufort County, South Carolina.
Amendments
The Company reserves the right to amend these Terms and Conditions at any time. Customers will be notified of any significant changes. Continued use of the Company’s services after such changes constitutes acceptance of the new Terms and Conditions.
